Halkı şiddete ve düzensizliğe teşvik etmek.

Eski İzmir yasası:

İzmir Şehri'nin çıkarları doğrultusunda, şehirdeki kargaşa ve huzursuzluk ortamını sona erdirmek amacıyla, en son çare olan devrim için İzmir Valisi'nin açık çağrısı ve desteği ile şehirde ayaklanmaya katılanlar bu suç bakımından masum sayılırlar.

Sistem tarafından otomatik olarak çıkarılan arama emirlerine istinaden özgürlüğü bağlayıcı ceza verilemez. Bu sınırlar dahilinde gerçekleşen olaylarda kişi en kısa zamanda serbest bırakılmalıdır.

The citizens who join a planned riot due to some special circumstances such as the Mayor of Izmir's open call and full support for a revolution as a last resort to bring an end to the chaos & disorder in the city, will not be held responsible for this paricular crime. Such persons will be considered innocent.


Bu başlığın altına yazılacak ilk mesajın sahibi bu suçun diğer şehir tanımlarında nasıl belirtildiğini araştırmak ve sunmaktan, İzmir şehir tanımının hazırlanmasından, başlık içerisindeki tartışmaların gidişatından sorumlu olacaktır.

Demokrasi bağlamında düşünüldüğünde bu durum yönetimden memnun olmayan halkın bu yönetime karşı duruşunu sağlamakta ve bu açıdan bakınca da genel anlamda yasal olması gerekmekte gibi görünmekte. Ancak, ayaklanmaya teşviği yasal kılmak yaşadığımız dünya göz önüna alınınca "çocuğun eline oyuncak vermek" anlamına da geliyor. Şehirlerin bu konudaki tutumuna göz gezdirdiğim kadarı ile (birazdan şehir yasalarında ayaklanmaya teşvik konusunda yer alan açıklamaları ekleyeceğim) genel kanı suç teşkil edişi fakat para cezası uygulamasının varlığı. (extrem durumlar da yok değil, bknz. Belgrad) Diğer bir genelleme ise, vali ve emniyet müdürünce destek verilen ayaklanmaların meşru kabul edilmesi. İlk bakışta bu mantıklı görünse de irdelendiğinde bu tutumun halkın beğenmediği yönetime karşı duruşu değil de yönetimin beğenmediği başyargıca karşı duruşu olduğu görülmekte. Günümüzde halk istemediği yönetimi vali ve/veya emniyet desteği almaksızın indirememkte. Bunun yanı sıra emniyet ve/veya başyargıç da istenmediği takdirde halk tarafından vali desteği olmaksızın indirilememekte. Vardığım sonuç bu konuda yasada ne yazarsa yazsın iplerin daima yönetimin elinde olacağı yönünde. Bu açıdan yasayı ele almaktan başka bir alternatifim (kendi adıma) yok.
Bu durumda ayaklanmaya teşvik suç kapsamına alınıp ortalama bir derecelendirme yapılabilir. Özel şehir tanımında ayaklanmanın hemen her koşulda suç olduğuna değinilir fakat zahiri durumlarda yasanın vali tarafından değiştirilebileceği hatta ve hatta ayaklanmaya teşviğin gerekli görüldüğü hallerde yasal kılınabileceği eklenebilir.
Ne açıdan ele alınırsa alınsın, yasa koyucu vali olduğu sürece ayaklanma halkın yönetime karşı elinde bulundurabileceği bir güç olmayacaktır.

The city of Amsterdam recognizes the right of its citizens to establish a city government, and to overthrow a city government that may reasonably be considered harmful to the city and its citizens. The city acknowledges its duty to administer the city in such a way that encourages personal freedoms and promotes the general welfare of all citizens. The government understands that, if it fails to maintain these freedoms and benefits, the people may take it upon themselves to cause a revolutionary riot in order to remove the city officials from power.

Because a riot is currently the only means available to the citizens to forcibly remove officials from power, the city of Amsterdam encourages the peaceful exchange of ideas and opinions, even those that are not popular, that may be considered dangerous or that are in direct opposition to the current government. The city asks that all citizens make use of public speaking areas such as our parks, television station and our city forum to express opinions of any kind so they may be discussed and debated freely, so that this exchange of ideas might lead to acceptable solutions rather than riots.

A riot is a public disturbance involving an act of violence by one or more persons who are assembled in a group. The act of violence must be one that presents a clear and present danger of injury to another person or damage to another person's property. Threatening to commit a violent act in such a group situation that could injure another person or damage property is also considered a riot if one of the persons in the group has the ability at the time to carry out the threatened violence.

New laws may be added and existing laws amended at any time by the Mayor of Nashville after a public forum takes place on any new information that becomes available. All laws of the City of Nashville are subject to interpretation by the presiding Judges currently employed by the Supreme Court of Nashville; the Chief Justice is empowered to overturn, overrule or otherwise re-interpret all judgments as is deemed necessary. All crimes will be subject to sentencing to the fullest extent of the law, except in special circumstances where noted.

Neresinden tutsan elinde kalıyor bu yasa. İstanbul forumdaki devrim başlığını açıldığından beri takip ediyorum. Aslında en güzeli ayaklanma olgusunu kaldırsınlar, halk geçerli sayılabilecek kanıtlar ile yönetim (vali/CJ) hakkında yüksek mahkemeye başvurabilsin herhangi bir kanıtlı olumsuzluk durumunda ve görevlerinin son bulma kararını yüksek mahkeme versin.

Yasaya ne yazarsan yaz, ayaklanmayı vali destekliyorsa CJ'ye ya da istemediği COP'a karşıdır, COP destekliyorsa yine CJ ya da istemediği valiye karşıdır, halkın elinde bir şey yok. Hal böyle iken ya ayaklanmaya teşvik tamamen kalksın ve yönetimden memnunsuzluk kanıtlandığı durumda görevlilere yüksek mahkeme el atsın ya da bu yasa kapsamı ihanet suçu altında şekillensin diyorum. Bir de yüksek mahkemenin yanına içtihadı birleştirme mahkemesi kurulsun, tüm şehirlerde verilen kararlar şehir özel tanımları dahilinde ele alınsın ve tek bir ortak içtihad çıkarılsın diyorum. Biraz daha abartıp Berke Cansu'dan ayrılsın da diyebilirim. İçimde ayaklanma çıktı İstanbul sayesinde
